Department of Homeland Security Withdraws Proposed Rule

What to Know About Obtaining a Green Card

When it comes to adjustment of status, the process can take a long time, and there are many requirements that one must meet to obtain a green card. Some of the requirements include the following:

• Attend a biometrics appointment and/or medical exam
• Submit to a criminal background check
• Interview with a USCIS agent

What Is a Biometrics Appointment?

If you are applying for citizenship, you will need to provide your fingerprints, photograph, and/or signature. This occurs at your biometrics appointment. This information is used to conduct background and security checks, among other things.

What Rule Did DHS Propose?

According to DHS, the proposed rule would have expanded department authorities and requirements for collecting biometrics by removing age restrictions and requiring the submission of biometrics for every applicant, petitioner, sponsor, beneficiary, or other individual filing for, or associated with, any immigration or naturalization benefit. They were also looking to codify the authority to use DNA test results.

Why Has the Rule Been Withdrawn?

According to DHS, “the withdrawal is consistent with the Executive Order 14012, Restoring Faith in Our Legal Immigration Systems and Strengthening Integration and Inclusion Efforts for New Americans, and additional administration priorities to reduce barriers and undue burdens in the immigration system.”

This is especially important considering DHS saw a major delay in biometrics appointments due to the coronavirus pandemic, halting the immigration process for millions of people.
